Andrew’s story – trial work

Andrew was asked by his cousin Peter if he wanted a few days work as a cleaner as Peter’s boss needed some extra staff for a big job that weekend. Andrew agreed to do the work. After finishing two shifts Peter told Andrew they would go to pick up their wages from the boss next Friday.

When Andrew received his wages, he realised he had not received the same amount of money as Peter. Andrew asked the boss, David, why he had less money. The boss told Andrew that he was on a probationary period and therefore did not get paid the extra money that Peter received for working at the weekend as a long term worker.

This is illegal! Anyone completing a work trial or working a probationary period is entitled to the full pay and benefits that any other worker would receive for the same work.

Andrew checked out the information on the Young People at Work website and discovered that he was entitled to the same minimum wage which Peter received for doing the same work.  Andrew went back to David, the boss and explained he was entitled to the minimum wage regardless of his experience. 

David called the Fair Work Infoline on 13 13 94 and found out that workers on a trial or probationary period must still receive the full rate of pay set out by the award.  David told Andrew it was his mistake… and paid up what Andrew was owed.
